Blue Flame Terms of Service

These Terms of Service ("Terms") govern your use of the Blue Flame app and related services (the "Service"), distributed globally via the App Store and Google Play.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Your acceptance is recorded at signup and when you accept updated versions.

2. Description of Service

Blue Flame is a voice-based social app that allows users to share audio content (posts), send direct voice messages, and participate in live voice rooms ("campfires").

3. Eligibility

You must be at least 13 years of age (or 16 in the EEA and UK, where required by law) and have the legal capacity to enter into these Terms. The Service is available globally subject to applicable law. Use from jurisdictions where the Service is prohibited is not permitted. If we discover that an account is held by someone below the minimum age, we may suspend the account and delete associated data in line with our Privacy Policy.

4. Accounts

You are responsible for: providing accurate information; keeping your account secure; all activity under your account. You may hold only one account per person. If we detect or reasonably believe you have created or are using more than one account, we may merge, restrict, or terminate the duplicate account(s) without prior notice.

5. User Content and Licence

You retain ownership of content you create. You grant Hallowed Ltd a non-exclusive, royalty-free, worldwide licence to host, store, transmit, display, and use your content as necessary to operate and improve the Service (including voice and campfire recordings). Campfire recording: Before any recording begins in a campfire, we will notify you (e.g. by an in-room notice or when you join). By joining a room that is recorded, you agree to that use; see our Privacy Policy for retention and your rights. You must not post content that violates these Terms or applicable law.

6. Prohibited Conduct

You agree not to: violate any laws or regulations; harass, threaten, or abuse other users; post spam, malware, or misleading content; impersonate others; attempt to access other users' accounts or circumvent safety or security features.

7. Intellectual Property

Blue Flame and Hallowed Ltd names and logos are trademarks. You may not use them without our prior written permission except as allowed in the app.

8. Termination

We may suspend or terminate your account for breach of these Terms. Where appropriate we may use warnings or temporary restrictions before permanent termination. On termination, your right to use the Service ceases. Content and data handling are described in our Privacy Policy and account deletion flow. If you believe a suspension or termination was applied in error, you may contact us at support@blueflame.blue or legal@blueflame.blue to request a review; we will consider your request in line with our policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE AVAILABILITY, ACCURACY, OR FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, HALLOWED LTD SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN JURISDICTIONS WHERE MANDATORY CONSUMER RIGHTS APPLY (E.G. UK CONSUMER RIGHTS ACT), WE DO NOT EXCLUDE LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes (e.g. in-app or by email). Continued use after changes constitutes acceptance. Where required, we may ask you to re-accept. Version history is stored when you accept.

12. Governing Law and Dispute Resolution

Hallowed Ltd is registered in England and Wales. These Terms are governed by the laws of England and Wales. Complaints: If you have a complaint, please contact us first at legal@blueflame.blue or support@blueflame.blue. If we cannot resolve the dispute, you may refer it to a recognised mediation scheme (e.g. CEDR in the UK). Courts: Subject to the above, disputes may be brought in the courts of England and Wales. Nothing in these Terms removes your right as a consumer in the EU/EEA to bring proceedings in the courts of your country of residence. You may also have the right to complain to a supervisory authority (e.g. the ICO in the UK).

13. App Store and Google Play

Your use of the Service via the Apple App Store or Google Play is also subject to the applicable platform's terms and conditions. If you obtained the app from the Apple App Store, you acknowledge that Apple has no obligation to provide maintenance or support for the app and that Apple is a third-party beneficiary of these Terms and may enforce them against you. For Google Play distribution, your use is subject to the Google Play Terms of Service where applicable.
